These terms apply to orders placed via the website of Hofgut Burgdorf. By submitting an order you accept them.
1. Provider and scope
The provider is:
HofgutBernstrasse 35
3400 Burgdorf
+41 34 422 43 55
restaurant@hofgut-burgdorf.chOperated by: Liyame Gastro GmbH
These terms apply to all orders of food and drinks for delivery or pickup placed via this website. They apply accordingly to orders placed in the restaurant or by phone. Deviating terms of customers do not apply.
2. Offer and prices
- All prices are in Swiss francs (CHF) including statutory VAT.
- Online prices may differ from prices in the restaurant. The price shown during checkout at the time of ordering applies.
- For deliveries, the delivery fees and minimum order values shown on the website per locality apply. The minimum order value refers to the goods value before discounts.
- Product images are for illustration; appearance and presentation may differ.
- Our offer is subject to availability; sold-out products are marked accordingly.
3. Ordering process and conclusion of contract
You select products and options, add them to your cart and go through the checkout steps "Details", "Time & payment" and "Confirmation". Before submitting, you see an overview of all items, discounts, delivery fees and the total and can correct your entries. By clicking "Place binding order" you make a binding offer.
Immediately afterwards you receive an acknowledgement with your order number on the order page. The contract is concluded as soon as we accept the order (status "Accepted"). We may decline an order without giving reasons, in particular when the kitchen is at capacity, outside the delivery area, for incomplete or obviously incorrect details or if misuse is suspected; you will be informed on the order page or by phone.
4. Delivery and pickup times
- Online orders are possible during our opening hours. Pre-orders are possible for the same day in the time slots offered.
- Delivery and pickup times shown are carefully estimated guidelines. Delays, e.g. due to high demand, traffic or weather, are possible and do not entitle you to withdraw from the contract.
- For deliveries you must be reachable at the address and phone number provided. If handover is not possible for reasons attributable to you (e.g. wrong address, absence), there is no entitlement to redelivery; we reserve the right to charge the order amount.
- For pickup, please be at the restaurant (Bernstrasse 35, 3400 Burgdorf) at the time indicated. Food that is not collected is not kept for food safety reasons.
5. Payment
You pay on handover in cash or by card (where offered). For cash payments, please have the exact amount ready if possible. Payment on invoice is only possible by prior arrangement. Online payment methods will be added to these terms once they are offered.
6. Changes and cancellation
Since food is freshly prepared to order and is perishable, there is no statutory right of withdrawal. Changes or cancellation are only possible by phone and only as long as we have not started preparing the order. We may cancel an accepted order in whole or in part for important reasons (e.g. technical failure, unavailability of a product, force majeure); any payments already made will be refunded in that case.
7. Alcoholic drinks and youth protection
- We only sell alcoholic drinks to persons aged 18 or over (stricter than the legal minimum age of 16 for beer and wine).
- You confirm your age during checkout. On delivery or pickup our staff check an official ID (identity card, passport, driving licence).
- If no valid ID can be shown, or if we suspect the drinks will be passed on to minors or the person is visibly intoxicated, the alcoholic drinks will not be handed over and will not be charged; the rest of the order will be delivered.
8. Allergens and ingredients
For every dish and in the configurator we show the allergens that must be declared. Since many ingredients are processed in our kitchen, traces of other allergens cannot be ruled out. If you suffer from an allergy or intolerance, please call us before ordering at +41 34 422 43 55.
9. Complaints
Please check your order on receipt. If something is missing or not in order, please call us immediately, at the latest on the same day, at +41 34 422 43 55. We will strive for a fair solution, e.g. redelivery, replacement or a credit. Claims for late delivery are excluded to the extent permitted by law.
10. Discount codes, promotions and loyalty programme
- Discount codes and promotions only apply during the stated period and under the stated conditions (e.g. minimum order value, once per customer). They cannot be redeemed for cash and are not transferable.
- Discounts apply to the goods value, not to the delivery fee. Discount code, loyalty discount and stamp card reward cannot be combined; the highest discount is applied automatically.
- The loyalty programme is only available to customers with a customer account. Only completed orders count; cancelled or declined orders do not. The applicable rules (discount tiers or stamp card, number of stamps, reward, validity) are shown in the customer account and during checkout.
- Stamp card rewards can be redeemed within the period shown from issue (usually 6 months). Collected stamps expire if no further order is placed within the period shown (usually 12 months). If an order with a redeemed reward is cancelled, the reward is credited back.
- We may change or end the loyalty programme, promotions and discount codes for the future. Rewards already earned remain redeemable until they expire. In case of misuse, discounts, stamps and rewards may be withdrawn.
11. Customer account and reviews
- A customer account requires truthful details. Keep your password secret; you are responsible for orders placed via your account.
- You can delete your account at any time in your customer account. We may suspend or delete accounts in case of misuse.
- Reviews are only possible for your own completed orders and must be truthful and objective. We check reviews before publication and may reject offensive, unlawful or obviously incorrect content.
12. Liability
We are liable in accordance with statutory provisions. To the extent permitted by law, liability for slight negligence and for indirect and consequential damage is excluded. Liability for personal injury and for damage caused intentionally or by gross negligence remains unaffected. We are not liable for outages or disruptions of the website, the internet or telecommunications, or in cases of force majeure.
13. Data protection
How we handle your personal data is explained in our privacy policy.
14. Changes to these terms
We may amend these terms at any time. The version published on the website at the time of the order applies.
15. Governing law and place of jurisdiction
Swiss law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Burgdorf; mandatory places of jurisdiction, in particular for consumers (Art. 32 Swiss Civil Procedure Code), are reserved. If any provision of these terms is invalid, the remaining provisions remain valid.
